CLS Files Amicus Brief on Behalf of Pennsylvania Homeowners

Michael Froehlich, the Managing Attorney of CLS's Homeownership & Consumer Rights Unit, filed an amicus brief in an important homeownership case that came before the Pennsylvania Supreme Court on September 26.  The issue before the Court is whether a lender is required to send a new pre-foreclosure notice before each new foreclosure.  In the case, JP Morgan Chase v. Taggart, the lender relied on a nearly three-year-old notice instead of sending the homeowner a new notice with updated information about what the homeowner needed to do to bring his mortgage current and avoid the foreclosure.  The brief was filed on behalf of low-income homeowners represented by Community Legal Services, Philadelphia Legal Assistance, Pittsburgh-based Neighborhood Legal Services Association, Community Justice Project, and the Pennsylvania Legal Aid Network.  The full brief is attached below.
